Terms of Service

Please read these terms carefully before using the Discover Docket platform. By accessing or using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the Discover Docket platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including law firms, attorneys, paralegals, and other legal professionals who access the Service.

Discover Docket reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our platform and updating the “Last Updated” date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

Discover Docket is a comprehensive legal practice management platform designed for law firms and legal professionals. The Service includes, but is not limited to:

  • Case and matter management tools
  • AI-powered legal research and analysis (J.I.L.L. — Judicial Intelligence Legal Logic)
  • Automated docketing and calendaring
  • Document drafting and management
  • Client relationship management
  • Billing and invoicing tools
  • Trial strategy and preparation tools
  • Secure client communication portals

3. Eligibility and Account Registration

The Service is intended for use by licensed legal professionals and law firms. By registering for an account, you represent and warrant that:

  • You are at least 18 years of age
  • You are a licensed attorney, paralegal, or authorized legal professional, or you are acting on behalf of a law firm
  • You have the authority to bind your organization to these Terms
  • All registration information you provide is accurate and complete
  • You will maintain the accuracy of such information

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify Discover Docket of any unauthorized use of your account.

4. Subscription and Payment

Access to the Service requires a paid subscription. By subscribing, you agree to pay all applicable fees as described in the pricing plan you select. All fees are:

  • Billed in advance on a monthly or annual basis
  • Non-refundable except as expressly stated in our refund policy
  • Subject to change with 30 days' prior written notice

Failure to pay subscription fees may result in suspension or termination of your access to the Service. You authorize Discover Docket to charge your designated payment method for all applicable fees.

5. Confidentiality and Attorney-Client Privilege

Discover Docket understands the critical importance of confidentiality in legal practice. We are committed to protecting the confidentiality of all client information and privileged communications stored on our platform. We implement industry-leading security measures including:

  • AES-256 bit encryption for all data at rest
  • TLS 1.2+ encryption for all data in transit
  • HIPAA-compliant data handling procedures
  • Role-based access controls and audit logging
  • Regular third-party security audits and penetration testing

However, you acknowledge that you are responsible for ensuring that your use of the Service complies with all applicable rules of professional conduct, including those governing confidentiality and attorney-client privilege in your jurisdiction.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable law, regulation, or professional conduct rule
  • Infringe upon the intellectual property rights of others
  • Transmit any harmful, offensive, or unlawful content
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Collect or harvest any personally identifiable information from the Service
  • Use the Service for any purpose that is competitive with Discover Docket
  • Reverse engineer, decompile, or disassemble any portion of the Service

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Discover Docket and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Discover Docket.

You retain ownership of all data, documents, and content you upload to the Service (“User Content”). By uploading User Content, you grant Discover Docket a limited, non-exclusive license to use, process, and store such content solely for the purpose of providing the Service to you.

8. AI-Powered Features and Limitations

The Service includes AI-powered features, including J.I.L.L. (Judicial Intelligence Legal Logic). You acknowledge and agree that:

  • AI-generated content is provided for informational purposes only and does not constitute legal advice
  • You are solely responsible for reviewing, verifying, and validating all AI-generated content before use
  • AI outputs may contain errors, omissions, or inaccuracies
  • The use of AI tools does not replace the professional judgment of a licensed attorney
  • You must comply with all applicable bar association rules regarding the use of AI in legal practice

9. Data Privacy and Security

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

In the event of a data breach that affects your account, Discover Docket will notify you in accordance with applicable law and our incident response procedures.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DISCOVER DOCKET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

IN NO EVENT SHALL DISCOVER DOCKET'S AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO DISCOVER DOCKET IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Discover Docket and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting our support team. Upon termination, we will provide you with a data export of your User Content for a period of 30 days.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules.
